Family Visas

Any non-EEA national who wishes to stay in the UK for more than 6 months needs to make a Family Visas application. You can do that if one of the following applies;

  1. Your family member/spouse is a British
  2. Your family member/spouse has ILR or Settled status
  3. You have a relationship with someone in the United Kingdom, who is a refugee or has humanitarian protection
  • • If you are already in the UK but with a non-family visa, you may be eligible to switch to a family visa which will enable you to stay with your family member.
  • • Family visas include many sub-categories and you can apply for one of them, depending on the nature of your relationship with them.

Child Dependent Visa 

  • • Children with non-EEA citizenship can apply for a UK Family Visa with their parents’/legal guardians’ application. They can also make a separate application.
  • • To be eligible for a Family Visa, children must be under the age of 18 at the time of the application. Meanwhile, they must live with their parents without forming an independent family unit. They also cannot be working full-time or be able to put some money aside.
  • • The parent or carer must meet the financial requirements if they wish to bring their children to the UK.
  • • As in the case of a Spouse Visa, after 5 years of continuous residency in the UK on a Child Dependent Visa, the child will be eligible to apply for Naturalisation.
 

Adult Dependent Visa

  • • Non-EEA nationals over the age of 18, who wish to live in the UK on a Family Visa should consider applying for an adult-dependent visa as they may be eligible for it. This is specifically tailored for individuals who want to live in the UK as a parent, grandparent or adult child of a British citizen.
  • • Exceptional circumstances are being put in place in order to apply for this visa. Only the persons who need long-term care can apply and even then, relative in the UK should be the only one who can provide such support.
  • • As an exception to most of the Family Visas, Adult Dependent Visa allows the dependent to remain in the UK indefinitely as long as the relative is either a British Citizen or has settled status in the UK.  Moreover, to make things easier, you can apply for it if your relative has refugee status or humanitarian protection in the UK.
  • • Adult Dependent Visa is hard to get approved of and special circumstances are being looked for. Applicants must fulfil the followings;
  1. You have to be able to put enough evidence forward to sufficiently prove that you do not receive adequate care in your country of origin,
  2. You have to be over the age of 18
  3. You must be related to the person(s) who has British Citizenship or Settled status in the UK.
